A recent court ruling has protected automatic student loan forgiveness for hundreds of thousands of borrowers under the $23 billion Sweet v. McMahon class-action settlement.
The agreement covers individuals who applied for loan relief after alleging that their colleges misled them about job prospects, potential earnings, or credit transfers.
Who Qualifies for Automatic Loan Relief?
Eligibility for automatic debt relief relies on specific filing dates and government response deadlines:
- Post-Class Applicants: Borrowers who submitted a Borrower Defense claim between June 23, 2022, and November 15, 2022.
- Exhibit C Schools: Applicants whose schools were listed in "Exhibit C" (institutions with major misconduct allegations) automatically receive full relief if the Department of Education failed to issue a decision by January 28, 2026.
- Non-Exhibit C Schools: Applicants whose schools were not on Exhibit C automatically qualify for relief if they did not receive a decision by April 15, 2026.
- Court Protection: A federal appeals court recently denied the Education Department's request to extend these deadlines, securing automatic relief for approximately 200,000 affected borrowers.
What Benefits Do Eligible Borrowers Receive?
Borrowers who qualify for settlement relief receive three main benefits:
- Complete Loan Discharge: Full cancellation of federal student debt linked to the school named in the claim.
- Payment Refunds: Reimbursement of payments previously made on those specific federal loans.
- Credit Repair: Erasure of negative credit marks associated with the discharged loans.
Key Steps for Borrowers
- No New Application Needed: If you qualify under these settlement deadlines or already received an approval notice, you do not need to submit another claim. Relief is typically processed within one year of approval.
- Update Contact Details: Ensure your contact information is up to date on your Federal Student Aid account and regularly check your email (including spam folders) for updates.
- New Claimants: If you did not file a Borrower Defense claim between June and November 2022, you cannot join this specific settlement. However, you can still file an independent Borrower Defense application if a school misled you.
